RIAA acts to kill Napster, Napster responds

On Monday the Recording Industry Association of America (RIAA), in cooperation with major labels, the Motion Picture Association of America (MPAA), and newly acquired cohorts MP3.com and EMusic.com, asked a US federal judge to grant an injunction that would effectively force Napster Inc. to shut down. Napster is the tiny, northern California based software company behind the most popular music file sharing software. It is based on central servers that are easily targeted by legal action. The move comes as alternate means of Internet based file sharing that are immune to shut down, such as Gnutella and Metallicster, are starting to make their own headlines.
    MP3.com CEO Michael Robertson, who recently agreed to a multi-million dollar settlement for a lawsuit brought against his company by the RIAA, said “Any such distribution would cause potential detriment to both MP3.com and the artists who upload their music to the Web site.”
    Napster immediately responded, saying their service “does not threaten copyright any more than any of the other technologies that have been developed in the past... Napster is a sampling and listening experience, not a permanent copying experience that would displace conventional CD sales...
